Element house product guarantee

Your prefabricated house (hereinafter: Product) is covered by a 10-year warranty on structural connections and a 2-year warranty on parts of the house. More detailed warranty conditions are described below. Repair or replacement of the Product during the warranty period does not result in an extension of the warranty period or the granting of a new warranty period. Parts replaced or repaired during the warranty period of the product will void the warranty when the warranty period of the product as a whole expires.

  1. General conditions of the guarantee:
    • The product must have been purchased from the Manufacturer or the Manufacturer’s official distributor (hereinafter: the Seller) and the final consumer of the product (hereinafter: the Buyer) must have paid the invoices submitted for the product at the time of the occurrence of the warranty claim.
    • The purchaser must ensure that the product has been selected for the intended purpose and is suitable for installation in the intended location.
    • The guarantee period starts from the delivery of the product to the Buyer after the signing of the shipping documents or the acceptance. The validity of the guarantee is subject to strict compliance with the instructions for use. Modifications to the Product or its parts must be agreed in advance with the Seller.
    • A warranty claim shall be deemed to be a possible defect in the construction of the product, a defect and/or absence of components, which are not excluded as warranty claims under point 2.
    • The Seller must be notified immediately of any defect in the Product that becomes apparent during the warranty period, but no later than five working days from the discovery of the defect. The basis for the complaint shall be the photograph(s), the description of the defect, the contract number and the delivery document number.
    • Warranty damage only covers the defective part that is replaced under warranty. The Buyer and the Seller will agree on the nearest possible delivery time and location. The warranty does not cover transport, installation, time or communication costs incurred in identifying and installing the defect. The Seller shall not be liable to the Buyer or to any third party for any incidental or consequential damages arising out of a defect in the Product.

1.7 In case of doubt, the Seller reserves the right to process the case for more than 14 working days, involving experts of its choice to clarify:

  • whether the product has been installed according to the instructions provided;
  • whether there are any circumstances which exclude liability under the guarantee as described in point 2.

1.8 The Seller has the right to claim back from the Buyer the expenses incurred for the handling of an unjustified claim.

1.9 The warranty applies only to products and parts thereof manufactured or installed by the Seller.

  1. No guarantee:

2.1 If the erection and/or transport has not been carried out by the Seller, damage caused by improper storage of the product after delivery of the product to the Buyer (storage exposed to the elements, in contact with the ground, etc.) or damage caused during transport and erection. Damage occurring during transport (in the case of delivery at the Buyer’s residence or place of business), which can be identified before the goods are taken over (before unloading from the truck), must be recorded by a photograph and communicated to the Seller.

2.2 The doors and windows of the product are movable parts that require adjustment from time to time. Adjustment is not covered under warranty.

2.3 If your house has been fitted with outriggers under the roof, terrace, awning, etc., by watering down the downriggers, the subsequent +/- adjustment of the bolts is not covered by the warranty.

2.4. Problems caused by poor ventilation or other factors related to poor indoor climate.

2.5. additional damage caused by a Warranty Event if the additional damage could have been avoided by the Buyer to a total or substantial extent.

2.5. The characteristics of wood as a natural material:

  • swelling, shrinkage (less than 5% in width or thickness), and differences in tone and warping of parts, which do not prevent installation;
  • the product parts have intact / ingrown branches that do not affect the stability of the product;
  • unplaned surfaces on the floor and roof boards, warping and knots, where it is possible to install the boards in such a way that these defects are concealed in the final finish (e.g. by turning the boards upside down);
  • knots up to 20 mm in diameter on product parts, including where they occur at the edges of product parts but are hidden by the final finish of the structure;
  • small gaps or cracks in the product parts (due to drying) which are not permeable and do not compromise the structural stability of the product;
  • the presence of resin pockets on product parts.

2.6 Damage caused by natural wear and tear of the product (e.g. wear and tear of floorboards or thresholds).

2.7. glass package/glass that has been mechanically damaged, broken or thermally shattered by the Buyer (thermal shattering of glass may occur if the temperature difference between the centre and the concealed edge of the glass or glass package exceeds a critical limit).

2.8. Causes related to normal physical phenomena (e.g. condensation on windows).

2.9. Curvatures of doors and windows within the manufacturer’s tolerances.

2.9. Damage to the product in unforeseen circumstances (such as vandalism, flooding, lightning or tornado).

2.10. The façade of the product has been primed and painted once, so it is important that you repaint the entire product once and apply a thin coat within 6 months. The condition of the paint coat should be checked at least once a year and the finish repeated if necessary.

The buyer loses the right to a product guarantee if:

  • The Buyer has failed to check the quantity, completeness and quality of the Product and its parts on receipt within a reasonable time after taking delivery of the Product and certainly before starting the erection.
  • Defective parts or components have already been installed or painted, but the defect would have been detectable during the inspection. The defect shall be fixed as described in point 1.5.
  • The Buyer has provided the Seller with false or insufficient information or missing proof of purchase documents in relation to the product or warranty claim.
